We for sure do. What I read the hunting regulations book we have that right.gwyoung wrote:ohiohntr, gave you some good advice on being pro-active, and talking to the Warden, and perhaps having the Warden to help out. You will also get the facts pertaining to the law from him. In West Virginia, we do NOT have the right to go onto another's property to retrieve our dogs, if we do so we are trespassing .

Tell the horse owners if they didn't have any horses that wouldn't be a problem. Smile sorta devilish when you say that and wink!!!!
Have them doing all the calling instead of you.

Re: Person theatening to shoot my dogs?
There is no way beagles are harassing or stressing horses. My family had Horses years ago and I remember when a strange dog went through their field, they had better get through quick because the Horses would be after them and I think the Horses enjoyed the chase. G.W. is right about WV, if you are hunting with dogs and the dogs go on private property you cannot be liable for trespassing. You do though have to have permission to go retrieve your dogs.

Re: Person theatening to shoot my dogs?
In Ohio we were faced with a situation where our dogs went on someone else's property, asked GW he said you are to be in control of your dogs at all times. They are not to be on the next guy's property without permission. He said the proper way to retrieve dogs on someone else's property is to leave your gun and amo at the property line, go directly to the owners house and ask permission to retrieve your dog. If they say yes then you can proceed. If no, you cannot.

Bob

I ain't got to awful much to say to someone who gets a gun out to kill a 25 lb little dog. What I will find is a way to make your life a living hell as long as I have the power. You will suffer much more than the puppy did. This world is full of ignorant heartless humans sickens me to hear these stories. These are much more than working dogs to me they are pets that I've got alot of money and time into. Making threats is one thing having and understanding is another threatin me or my dogs you gained a new problem. You will have no clue what you got yourself into I will make my own laws if you start throwing guns around. All who can stand behind hurting a dog doin it's job need to try out how a little lead feels themselves. JMO I personally have had livestock come at my dogs almost everytime I've been close to them. This man sounds like an idiot who is trying to use his 4 acres to his fullest power. It's like sayin if one of them horses come over here and is a treat to my dog on my property I'm goin to kill it. Which has never crossed my mind. I will say jackass donkeys will kill a beagle in no time flat. I've seen em come from 400 yards away just to try and stomp a dog. Needless to say I knew what to do get the dog and get the hell out of that place. The donkey or mules are doin a job as well they will kill yotes the same way which makes sense why they are aggressive to little beagles. None of these things are the animals fault. It's just humans throwing weight around which is a joke these days.
Others on here have much better advice than I did but I'd say you better video him shooting the harmless dog being shot or you dang near have no case this day in age. No none of it worth your own life but I'm a firm believer in stand up for what you think is right!

First off I'm upset for you! However I would highly recommend you do whatever it takes to keep your hounds off that persons property. The best advice I would give you would be to start off on a good note with the person on who's property your dogs are going.I would recommend you let them know that you will do your very best to keep the dogs away from thier livestock. If the person was breaking a law then it would be a great idea to film however what I see in this scenario will be you filming your dogs "crime" I would say the sheriffs office did inform the livestock owner to kill your hounds if on thier property and if here in Ky I don't think there would be anything legally you could do about it.rackhntr wrote:I have 25 acres leased to run dogs on and hunt on. The person beside of it has 2 acres leased with 4 horses on it. Every once in awhile my dogs will swing over on the 2 acres after a rabbit and then come right back. The person with the horses said it bothered them and the next time he caught them on that property he said he would shoot them all. By law what rights do I have to go on if he kills my dogs? I'm in Tn!
I'm not taking up for the horse owner I'm just giving you what little knowledge I have of how the law would work in some cases. If you still plan to run there you probably should do as someone else recommended and keep a shock collar on your hounds to keep them in check and stay as far away from the livestock owner as possible.
It would be well worth the extra money if you could find a way to lease those two acres!Maybe you could talk to the actual land owner and let them know that the 25 acres you are leasing is worthless with the other guy threatening to shoot your hounds?

I would try to talk to them and work it out. As a live stock owner, all he has to say is your dogs are chasing my live stock and I shot them. It's your word against his. It's not worth the life of a good beagle. I would invite him hunting and show him what the dogs do.

Go buy you a couple of hogs and build a small hog pen on your leased land right next door to his leased land and if his house is near by he will choke on the aroma when the wind is blowing in his direction.

By the same token, if the fence happens to be down one day and horse happens to be chasing your beagles, you have every right to protect the little guys.. It is a two way street.
I would contact the owner of the property and offer to lease the lands hunting rights for a specific fee.

Re: Person theatening to shoot my dogs?
i had a friend whose family owned like 3000 acres of land a neighbor owned a long narrow strip maybe 20 acres. My friend ran deer dogs legal here sometimes they would cross the small narrow strip that neighbor owned. The neighbor comes to my friends house tells him if your dogs cross my property he will kill them my friend gets so hot his brother had to hold him back. He tells this man you have 10 seconds to get off his property or someone will be doing life in prison as the neighbor leaves he shouts for every dog you kill one your cows will die and screams I will go to the electric chair for my dogs starts screaming grabs an axe ran him to his truck.I am glad he left as my friend would of have beheaded him. That ended that years go by they just dont speak no dogs have died.Shame some things like this happen.
Re: Person theatening to shoot my dogs?
Thanks for all the info guys! Ive actually had my place leased now about 8 years and have set up the perfect rabbit habitat. Ive kept all the field edges mowed out with clover and orchard grass ggrowing. The middle I have let grow up in briars and whats woods I've made lots of brush piles. It holds several rabbits and I've never killed one there. It just makes me sick that this has happened! Ive got the best dogs I've ever had now and its getting harder and harder to find places to run them. I think I'll just let things cool down a bit and just keep on running them there and see what happens. I might have to turn to drastic measures in the court of law!
