Really what this comes down to is a simple case of Internet Fraud. Nailing this kid down will take some work but if you do... Internet Fraud is a Felony punishable by up to five years imprisonment, plus fines of up to $250,000.

An IP address would go a long way to building the case. Get together with all the other people this kid has taken, petition Bev for the IP address, and take everything you know to the FBI field office in Louisville.

First go to State Troopers with it. Then FBI. He will be given a choice of producing a dog exactly as he advertised or refunding the money. He will be on record then and any other fraud will nail him. These people operate on the assumption that nobody will go to the trouble for a small amount of money.also that you---the victim is afraid of jail for beating the hell out of them.

Ok not trying to shake a hornets nest but just to give you some facts about laws and trials. I ended up losing out on about $2800 trying to get somone prosecuted for a deal very similiar to yours. Here are the facts: Any lawyer will tell you fraud by deception is one of the most difficult charges to prove and then if you add performance animals (i.e. beagles, horses) of any kind into that equation it gets twice as hard. The reason for that is in order to decept you they had to knowingly do it. Well, what it boils down to in a courtroom if the defendent gets a lawyer that is any count at all they will argue that the performance of an animal is based upon onces personal judgement. Then they will throw in the fact that in dogs or showhorses that WE even use judges at our events to evaluate a dog based upon there personal judging.

To make a long story short this case is a hard one to won. Best thing you can do is go file a civil suit in small claims court for the price of the dog plus any travel involved and then if you lose you are only out $200 at most.
