Alcohol is not an illegal drug. Consuming alcohol over the legal limit permitted to operate a motor vehicle is. If he was indeed over the limit then he should face the same consequences as any other citizen in that state. With the margin of error of portable breath analyzers he could possibly be within the legal limit based on the reading given. A blood test would reveal that information.
