Actually small claims court is just the forum for such cases when the dollar amounts are minimal.

Many of these dog deals are in different states, (this one was). Your going to travel 250 miles with gas @ $4 a gallon to claim a $200 loss. And if the guy doesn't show up? Ok, so they put a warrant for his arrest. Might owe 1000's in child support, other legal claims, likely will get picked up for DUI. Lodged in jail (tax payer exp). Still wont pay you. Might get some credit for time served (taxpayer exp).

Im being rediculously argumentative about this, but I've seen it many times over. Low life will be low life. Honest guys will make it right. These low life see themselves as the victim. I left the State Police after 5 years, its just pathetic. Now Im in the military spending time in Iraq and Afghanistan.....this is pathetic too..... (taxpayer exp):shock:

The best course of action is be careful who you trade with. Get cash/papers in hand and still be prepared to take a loss in the end.

I don't disagree with you and haven't from the start and you are right in that I believe there are many more honest people than there are crooked ones. There will always be crooks when there are "DEALS" made, my intent was to merely state that "DEALS" put to writting take out the misinterpretation of what is expected and what was received or not received. Will this stop crooks, NO, and most of them would NOT put anything in writing to begin with. I can tell folks that if I sell something I'm more than happy to put what I say in writing as my word is just as it will be written and I would not be offended if someone asks me to. I've always felt that "DEALS" should be able to be made via the internet because most folks are honest BUT alot of times deals go sour due to lack of understanding between the parties and not flat out lies.

Lets set the record straight.
First, I GAVE Nellie to Ernie Weir for 2 pups if she was bred, no money changed hands, therefore no contract in a court of law (for all you legal eagles out there).
Second, Ernie sent the dog to Michigan but not Shawn Moss.
Third, the guy in Michigan gave her to Shawn Moss. I had no dealings with him and he had no reason to expect papers. He probably wasn't even told about the pup deal but was told about papers. Selective hearing or speech, but not my problem.
Forth, Shawn Moss received the papers last week without comment on this board after causing a lot of crap.

Last, my 2 pup requirement in exchange for Nellie is NOT removed because someone else now has her.
In the past, I have NEVER received puppies due after signing over the papers. So Shawn you had NO right to the papers until my puppy requirement was settled.
I don't care how many people pass this dog between themselves, I owned the dog and had a puppy requirement, which still stands. The only reason I sent these papers is I doubt she will have any pups.

Now Man up and post that you got the papers even though you were never involved in the discussions and had NO claim.

That's the rest of the story.

I was the deal maker with ernie. To be honest i dont remember what the deal was but i couldnt raise the pups so i asked shawn if he wanted to raise the pups and ill do the dealings, shawn payed for the dog to get here and i did the dealings.

It wasn't all purchase price. Some of it was shipping, some of it was starting, some of it was just getting someone to take them to the woods......but it all adds up. My wife lets me know exactly how much I have into them.........

Having 4 young dogs ready to really get after it when I get home.......priceless!

Just think, if one of the four turn out to be special, you can spend another $2000+ hitting the trials, another $1000 in premium foods/care, to have someone offer you $800 for her........

My Beagles, when I was fighting in the jungle in Vietnam, I sent my entire monthly stipend home to my dad with but one request, he find me a good dog. I figured, if I lived, I didn't give a darn, and if I didn't well I still wouldn't give a darn. It was about all I had to look forward to and as you say, " absolutely priceless". Right here is a PRIME example of "he said, she said" verbal agreements. FACTS are the dog is in someone elses hands and they now have the papers so the dog is theirs signed, sealed and delivered. The verbal deal was null and void when it left the hands of the original parties involved and after that whatever agreements were made between those parties were with them. The original owner of the bitch is crap out of luck for any pups even if the female does produce any as the new owner, with the papers in hand didn't make that deal to our knowledge. Since he has the female and the papers possession is 9/10 of the law and he is the sole owner to do with and as he pleases with the female AND any pups.

I was talking to one of my friends today and he told me to check the internet, I've been busy hunting. Wow, looks like your trying to stir the pot still. I attached your response to me from april, when I asked who had the papers on Nellie.

The papers were given to Ernie when he got the dog, so I don't know where they are. If you don't have them then I guess Ernie does or did. If he didn't register her in his name then she would still be registered in mine. I just check the AKC I'm still the owner. I really liked that old girl. She has the brightest eyes and personallity. She still acts like a pup.

I hope she is doing good for you. I talked the Ernie today and just found out he sent her up there. I'm glad she is getting run. How is she working out for you?

If you look back at page two, I did send a apology to Ernie, told him I was sorry for the post. Again, because of the private message you had sent to me. You gave the papers with the dog to Ernie. Also, I sent you a private message for sending the papers to me as well. Remember I said Thanks for the papers.

Now the final question everyone wants to know or assume. The dog is not bred, I still have the dog, she is not sold. I just wanted someone to follow up on a deal made. Granted their were toooo many people involved with this deal.

Bob, you should be happy that I do have Nellie, because my dogs are spoiled and do get run. Just curious on how long she sat in a pen. The first time I ran her for an hour she could hardly walk. She had no muscle tone at all. I don't expect anything from her, but someday when she goes you can rest assured she had a good life at my house.

Will I ever deal with dogs outside of my own association, I sure hope not. I know this would have never been a problem in NMHA, folks know me and I know them. And I get along with all of them very well.

If I was in Hatteras bob's position. I would have kept the papers until I got my 2 pups in return. Regardless of what other deals were made or who ended up with the dog. Nothings free and sounds like at the end of the day Bob lost out on the whole deal. He obviously didn't get the 2 pups that were agreed upon and he still gave the papers up. Better man them me!!!
