Ernie,
I asked Hatterasbob and he said you have the papers on Kemler's Blazing Nellie. Well its been 5 months and you will not answer my private messages. Send the papers on the dog. A deal is a deal! You said Hatterasbob had the papers on her, and he said you have them. I made the deal with you. Your responsibility. No one elses.
Shawn Moss
Shawn,
We only talked once, but my understanding was you wanted a puppy starter and hoped for a possible breeding. I gave that bitch to Ernie to bred to Max with the understanding, if she took, I got 2 pups. She had 7 the time before. I gave Ernie the papers at the time of delivery of Nellie and a IFC Murray's Holp Prop bitch. What happened to the papers I do not know, but if you want them, then send me a check for $15 and I will get a duplicate set and send them to you. For the record she was born on Apr 10 2000. As for "lookin old" she was the most entergetic 10 year old I've ever seen, with very little white on her face, when I last saw her. You didn't get any pups and that was a chance you took, but you got a puppy starter.

Sorry about the papers, but that is the best I can do!
Bob

I think "Mybeagles" has it right on the nail. Must be something in that water in Afganistan that makes one see clearly what is important and what is not. eh?

I'm not saying you aren't owed the papers if that was agreed to, but now that you know how old the dog is why would you want or need them? I'd just make a mental note of who and how I got screwed and try to avoid those folks and situations in the future.

Well, I looking for papers for another dog and low and behold I found Nellie's papers. So it was MY ERROR not Ernie's.

Shawn, send me your address and I will send you the papers. I hope you enjoy Nellie, she was one of my favorites. I called her bright eyes. Always excited to see you.

Sorry,
Bob

Bob,
Sorry for the delay, my grandkids were up from Austin. I've been visiting. As for the puppy starter, what are you talking about? I do have the private messages, where we discussed Nellie! I will send you private message with my address, I will wait and see if I get them.

I made a similar deal with Ernie and had a heck of a time getting the papers but he did everything he could to make it right. the bitch was 3 1/2 half and was bred very well. A little tight in the mouth but otherwise a very nice bitch. I had another friend breed to Max and still has four out of the litter. He sent two of the pups to Ernie and it took Ernie a while to send him money for the pups but he did and was very apologetic about the mixup. Ernie was very helpful in registering the pups and helping connect people to make transport on all ends as easy as possible. Do I think Ernie has a lot on his plate and may be a little absent minded at times, absolutely. However, do I think he would purposely screw anybody over, NO!!!

Mybeagles,
First let me thank you for your service.
Now, I'll answer your question with a question as by answering it you will probably answer your own question. Would this person be able to prove this verbal "DEAL" were it put to paper and have a means of relief?
With a bit of experience in law enforcement, even if he had a court document notorized by the judge, he would be out far more money in time, lawyer, legal fee's, etc than the papers/dog would ever be worth. If I was buying a 10K field champion with conditions then a contract or written agreement may be helpful but the everyday $200-$400 deals....not so much. If you have purchased or sold dogs very long, someone has screwed you. Ive been screwed, but I considered it part of growing up and learned my lesson. There are enough lawyers and legal battles going on over "spilled coffee", I just chose to keep it out of beagles.

Just like Buck said, this forum does a great job of exposing crooks and distinguishing them from oversights or accidents. For example, David Diggs is a crook, but this papers situation was resolved and was an oversight. I have heard Hattersbob named several times and always as being an honest beagler. This is no exception, he realized he had the papers Shawn wanted and is going to mail them to him. Had this not been posted Shawn likely would never recieved the papers and he would have went to the grave thinking Ernie screwed him.

Actually small claims court is just the forum for such cases when the dollar amounts are minimal. I've been a witness when two friends had a misunderstanding of a "DEAL" and trust me the one bringing the claim to court won the case PLUS got additional money when they had to poursue it that way. Never stated that all deals should be in writing but if so there would be no gray shading things up.
